What are the fines and punishment for graffiti in San Francisco?
According the CA Penal Code 594 graffiti means a person who:
- Defaces with paint or any other liquid;
- Damages; or
- Destroys any real or personal property not his/her own
Graffiti that is valued at $400 worth of damage is punishable by up to 1 year in jail, a $10,000 fine or a combination of the two. Graffiti damage estimated to exceed $400 can be punishable as a felony in San Francisco – even for minors. Damages in excess of $400 can be punishable by up to 3 years in state prison and a fine of as much as $50,000.
If the graffiti occurred on a place of worship the graffiti, regardless of the damage amount can be punished by up to 3 years in State prison. Graffiti done by using a acid or other caustic substance can be punished by up to 3 years in State Prison and $50,000.00 fine.
